1. The agreement
WPB Build is operated by WPB Holding Ltd, registered in England and Wales under company number 17520349. Its registered office is 5th Floor, 167–169 Great Portland Street, London, W1W 5PF.
By creating a builder account or using WPB Build on behalf of a business, you agree to these terms for yourself and that business. A homeowner who opens a private job page agrees to the sections that apply to that page.
You must be at least 18 to create or control a builder account and must have authority to act for the business you name. If you obtain the app through Apple or Google, the applicable app-store terms also apply.
2. What WPB Build does
WPB Build helps building teams share progress, photographs, job stages, variations, questions and payment records with workers and homeowners. It is a communication and record-keeping service.
WPB Build does not provide building, surveying, legal, tax, accounting, escrow or regulated payment services. It does not transfer money. A displayed payment status means only that an authorised builder user recorded it that way.
The initial UK service is offered as early access without a subscription charge. We may introduce paid plans later, but we will explain the price and obtain agreement before charging an existing user.
3. Accounts, workers and private links
Keep login details secure, provide accurate account information and tell us promptly if you suspect unauthorised access. The account owner is responsible for people invited to its workspace and for removing access when it is no longer needed.
Worker permissions are designed to limit access, but the account owner remains responsible for choosing appropriate assignments and checking who can see each job.
A homeowner link is private but is not a password-protected homeowner account. Anyone holding a valid link may be able to open the page. Share it only with the intended people and replace it promptly if it is disclosed incorrectly.
4. Variations and payment records
WPB Build records information entered by its users, including variation responses and payment statuses. The parties remain responsible for checking the scope, price, tax treatment, contractual effect and accuracy of every record.
An electronic approval or query may form part of the parties’ evidence, but WPB Holding Ltd does not decide whether a building contract or variation is legally enforceable. Users should obtain professional advice where a decision is important or disputed.
Do not rely on WPB Build as the only copy of information that a law, contract, insurer or accountant requires you to retain.
5. Job content and acceptable use
You keep ownership of content you submit. You give WPB Holding Ltd a limited permission to host, copy, process and display it only as needed to operate, secure and support WPB Build.
You must have the right to upload photographs, names, contact details, documents and messages. Tell workers and customers how their information will be used, avoid unnecessary personal information and obtain any permission required before photographing people or private property.
Do not use WPB Build to:
- break the law, mislead, harass or infringe another person’s rights;
- upload malware, unlawful material or content that creates a safety risk;
- access another business’s data or test the service without permission;
- send spam or expose a homeowner link publicly; or
- store payment-card details, passwords, medical information or other sensitive information not needed for the job.
We may remove content or suspend access where reasonably necessary to protect people, comply with law or investigate misuse.
6. Writing assistance
Some versions may offer optional tools that tidy a note or extract draft information from text. These tools can be wrong or incomplete. The user must review and approve the result before saving or sharing it. Do not submit unnecessary confidential or sensitive information to an assistance feature.
7. Privacy and customer information
Our privacy notice explains how WPB Holding Ltd uses account and operational information. When a building business uses WPB Build for worker, homeowner and job information, the data-processing terms form part of this agreement.
The building business is responsible for having a lawful basis, providing any privacy information it owes to its workers and customers, and responding to their requests. We will provide reasonable assistance as described in the data-processing terms.
8. Availability and changes
We aim to provide a dependable service but do not promise uninterrupted or error-free availability. Internet, hosting, email and device failures can affect access. Keep separate copies of records that are essential to running a job.
We may maintain, fix or change WPB Build and may discontinue a feature where reasonably necessary. We will give reasonable notice of a material reduction to the service where practical.
During early access, features may change more frequently. Feedback may be used to improve WPB Build, but submitting feedback does not transfer ownership of your existing intellectual property.
9. Responsibility and liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or anything else the law does not allow us to exclude. Nothing affects a consumer’s statutory rights.
For business users, WPB Holding Ltd is not responsible for indirect or consequential loss, lost profit, lost opportunity, loss caused by inaccurate user-entered information, or a dispute between job participants. Subject to the paragraph above, our total liability connected with WPB Build in any 12-month period is limited to the greater of £100 and the fees paid for WPB Build during that period.
A homeowner does not pay WPB Holding Ltd to access a private job page. The builder remains responsible for the building work, customer relationship, job records and amounts displayed.
10. Ending use and deletion
You may stop using WPB Build at any time. Any account holder can initiate deletion of their login from the Profile area. An owner can delete the whole business workspace and can delete individual jobs from job settings. We may suspend or close an account for serious or repeated breach, legal requirements, security risk or prolonged inactivity, giving notice where reasonably possible.
Deletion is handled as described in the privacy notice. Information may be retained where the law requires it or where reasonably necessary for fraud prevention or an active dispute.
11. General terms
These terms and the documents linked from them form the agreement about WPB Build. If one provision is unenforceable, the remaining provisions continue. A delay in enforcing a right does not waive it. You may not transfer this agreement without our permission; we may transfer it as part of a genuine restructuring or sale of the service.
We may update these terms for legal, security or service changes. We will give reasonable notice where a change materially affects existing users.
English law governs these terms. The courts of England and Wales have jurisdiction, except that a consumer may have the right to bring a claim in the part of the UK where they live.
